Pain and Suffering

Post by Porter »

Does anyone know how an insurance company determines a pain and suffering payout?

Thanks,

I know it sounds strange, but I actually have a buddy that is an adjuster. He has a rule of thumb of 1 to 1.5 times the medical costs to determine this. It's just a rule of thumb, though. Usually applied to the claims where full recovery occurs and med costs are minimal, say under $5K.

By "pain & suffering" I presume you mean the "non-economic damages". Hope this helps.
