1099-WC

Kind of a dumb questions. Seasonal workers-1099 have to be covered under WC, right? I have a client who hires temp workers to complete the project, they are 1099s. I just asked her what was her reported payroll for 2005 and i will base my submission on that number

Check with your state requirements. Sounds like your prospect is dodging Uncle Sam. In this state the seasonal ee's would be employees by stature and are required to be covered by w/c

I am a premium auditor in the Southeast. We would pick them up and charge for them at audit.

InsagentSF, not a dumb question, because at one time 1099 could dodge WC, not any more. In CA, 1099 must have WC provide by the issuer of 1099 pay usually through and employment service. The only way around not carrying force WC, you must be able to prove your completely self employed and your taxes must reflex the same and also be in several IRS classes. Like insurance agent not producer. Realtor Brokers must carrier WC for their realtors now even though they are paid on 1099 commission split. Tell your client it's a $10,000 fine for not suppling WC
