Reefer breakdown - Having a claims issue..

I am having a problem currently with a client, who happens to be my mom's husband, who purchased a cargo policy with the reefer breakdown endorsement about a year and a half ago.. well he was carrying an expensive load.. some asparagus.. and the company will not cover the claim because it had a clause that he had to inspect the refridgrator every 30 days and keep records.. well he didn't do that.. but him and i were both unaware of it but that's because nobody read the stuff they sent! Anyway, the question i have for you truck insurance poeple out there is is it common practice to inspect your reefer every day/week/month? Because he wasn't doing any of that at all except for April, but i spok ewith a trucker's wife and she was telling me they do it every day/week/month.. so i'm wondering.. was this negligence on his part?

You as the insurance agent/broker, should have pointed out this endorsement to your client. As an insurance agent/broker, it is vitally important that you point out any specific endorsements that might limit the applicability of coverage.

Using the excuse that you were unaware "because nobody read the stuff" won't hold water.

Yes, it is common practice to do regular inspections of all trucking equipment, be it the cab or any trailer assembly. Refrigeration assemblies need regular maintenance, and that's the purpose of requiring a monthly inspection. Hate to say it, but it's just common sense.

Reefer units break down all the time, hoses come loose, etc. Yes, you should inspect at least every 30 days, but most companies will inspect weekly, if not more often. I created a simple vehicle maintenance checklist for my small trucking clients that drivers or mechanics can use to show they're doing the inspections. It's a 1/2 page, and has a place for specialized equipment like lifts, reefers, etc.
