Optimizing the Internet Connection

Investigators with the CDI Criminal Investigations Branch arrested a Sacramento man, Louis Nhat Phan, 20, on two felony counts of insurance fraud. Phan was arrested at work and booked into the Sacramento County Jail. Bail was set at $3,000.

According to investigators, on Feb. 6, 2001, at 1:15 a.m., Phan purchased an insurance policy with Progressive Insurance over the Internet. On Feb. 7, 2001, at 7:38 a.m., Phan called Progressive and reported his vehicle had been vandalized in front of his brother’s apartment complex on College Town Drive in Sacramento. Phan allegedly claimed he had gone to his brother’s apartment at 1:30 or 2 a.m. on Feb. 7, and discovered the vandalism later that morning.

The investigation revealed the vandalism to Phan’s vehicle occurred prior to the inception of the insurance policy. Six witnesses saw Phan’s vehicle with the same damage he alleged in his claim prior to the policy being in force. One of the witnesses actually saw the vandalism occur during two separate incidents on Feb. 4 and 5, 2001, at Phan’s apartment complex in South Sacramento.

Additionally, two offices from the Sacramento Police Department saw the damage on the vehicle at 11:11 p.m. on Feb. 6, 2001. That officer, who made contact with Phan after the initial vandalism, stated that Phan had declined to make a police report.

If convicted, Phan could face up to five years in state prison and/or a maximum fine of $50,000. The Sacramento County District Attorney’s Office is prosecuting the case.
