Disc Jockey Caught in Fraud Scheme

Kenneth W. Fitzwater, 46, of Citrus Heights, Calif., was arrested at his residence on five counts of insurance fraud.

According to CDI investigators, Fitzwater was injured when he fell from a ladder while working for Sacramento City Electric on Feb. 18, 1999.

On Oct. 28, 1999, Fitzwater completed an initial evaluation for vocational rehabilitation. He reported he could not perform activities that included lifting more than two or three pounds, bending, stooping, twisting, and climbing.

On Oct. 30, 1999, Fitzwater was videotaped working as a disc jockey and observed performing those activities that he stated he could not do or avoided performing.

Throughout the investigation, Fitzwater saw doctors for treatment of his injures and continued to collect benefits due to those injuries. He was also videotaped on numerous occasions performing activities beyond his stated abilities and limitations. Total loss to State Compensation Insurance Fund as a result of this fraudulent claim was $28,141.
