BHSI Introduces Employment Practices Liability Cover in Canada

Berkshire Hathaway Specialty Insurance (BHSI) announced it has expanded its Executive First policy suite in Canada with the launch of an employment practices liability policy.

The policy is designed to protect companies from the full range of employment practices claims, including wrongful termination, harassment, discrimination, retaliation and failure to employ or promote, said BHSI, noting that there is also a solution available by endorsement for “pay in lieu of notice” damages.

The policy clearly articulates coverage for the latest exposures employers face, including those arising from genetic information, military status, sexual orientation or preference and improper internet activity. Coverage extends to sexual or workplace harassment of any kind and to allegations by employees, as well as third parties, such as customers.

Limits of up to $25 million are available.

“Our EPL policy provides Canadian companies with a simple, clearly written solution for complex risks,” said Michael Densham, head of Executive & Professional Lines, BHSI in Canada. “It’s backed by BHSI’s underwriting experience and dedicated local claims expertise led by Paul Emerson, our head of Liability Claims in Canada.”

The EPL policy is the latest addition to BHSI Canada’s Executive First suite of products, which provide “current and customizable executive liability coverage for commercial and financial firms, including those with the most complex risk-transfer needs,” BHSI said.

Along with EPLI, the suite includes D&O Liability Insurance, Side A DIC Liability Insurance, and Fiduciary Liability Insurance.
