A state insurance fund has rejected a claim filed by North Dakota State University for the collapse of Minard Hall.
The State Fire and Tornado Fund letter of denial obtained by The Forum newspaper says the incident was caused by a nearby excavation.
NDSU sued the Fire and Tornado Fund, seeking a judicial order to force the insurer to cover the claim.
Portions of Minard Hall, the largest academic building at NDSU, collapsed in the midst of an expansion project in December 2009 when the northwest wall failed. The university originally filed a $500,000 insurance claim for the damage to the 100-year-old building.
NDSU officials subsequently revised the expected costs associated with the collapse to at least $1 million.
Dan Hull, a Fargo lawyer representing NDSU in the lawsuit, says the university has accrued more than $1.3 million in damages related to the collapse, though the specific amount it claims the insurance fund should cover is undetermined.
