XL Group, ABA Insurance Enhance EPLI Coverage for Commercial Businesses

The insurance operations of XL Group and ABA Insurance Services Inc., a managing general underwriter, have expanded their employment practices liability insurance (EPLI) product to include additional protection such as wrongful Internet coverage and legal assistance. The coverage offers more protection to commercial businesses against claims made by employees or former employees.

“In today’s economic climate, claims against employers have consistently trended upward. Last year alone, the Equal Employment Opportunity Commission received close to 100,000 claims and collected some $455.6 million in fines against businesses of diverse sizes and industries,” said David Zell, vice president and program manager in XL Group’s Select Professional business.

Zell says employers are growing more susceptible to employees’ use of Facebook, Twitter, blogging and other social media outlets and the latest policy update includes wrongful Internet coverage which extends wrongful act coverage to the use of social media.

Clients are also given access to legal advice which includes an employment termination helpline, news alert service and an online library of human resource documents and reference manuals.

Employment practices liability insurance addresses claims related to discrimination involving age, sex, race, disability, etc., as well as wrongful termination of employment, sexual harassment, and other employment-related allegations. ABA Insurance Services’ provides EPLI coverage to small and mid-size businesses with fewer than 250 employees through the XL Group insurance company, Greenwich Insurance Co. Available coverage and services provided include:

  • Full prior acts coverage
  • Defense outside the limits option
  • Wrongful Internet coverage
  • Duty-to-defend provision
  • Liability limits up to $2 million
  • Retentions as low as $2,500
  • $100,000 defense sublimit for Fair Labor Standards Act (FLSA) claims (not available in CA)
