Texas Sets Workers’ Comp Maximum Weekly Benefit at $895

The workers’ compensation state average weekly wage for dates of injury from Oct. 1, 2015, through Sept. 30, 2016, has been set by the Texas Department of Insurance’s Division of Workers’ Compensation at $895.08.

The maximum weekly benefit rates for workers’ compensation income benefits is $895 and the minimum weekly benefit rate is $134 for that period, the DWC said.

The maximum and minimum weekly benefit rates for dates of injury from Oct. 1, 2014, through Sept. 30, 2015, were $861 and $129 respectively.

In accordance with Texas Labor Code (TLC) §408.047, the workers’ compensation state average weekly wage is equal to 88 percent of the average weekly wage in covered employment as computed each year by the Texas Workforce Commission.
