The Arkansas Workers’ Compensation Commission has determined that the maximum weekly workers’ comp rates for 2016 for covered accidents will be $646 for total disability (TD) and $485 for permanent partial disability (PPD).
For injury or death on and after Jan. 1, 2016, through Dec. 31, 2016, the maximum for workers’ compensation weekly indemnity benefits is based on 85 percent of the state average weekly wage (AWW) of $760..
The AWW is determined by the Department of Workforce Services. That sum is used by the Arkansas Workers’ Compensation Commission to calculate compensation rates for injured workers.
For total disability, workers in 2016 get 66 2/3 percent of their individual AWW, rounded to the nearest whole dollar, up to a maximum of $646.00 (85 percent of $760.48 = $646.41), which rounds off to $646.00).
If the TD is $205.35 or greater, the PPD maximum is 75 percent of TD, rounded to the nearest whole dollar, up to $485.00 (75 percent x $646.41 = $484.81, which rounds off to $485.00).
If TD is less than $205.35, PPD is 66 2/3 percent of the worker’s AWW, up to a $154.00 maximum.
The minimum weekly PPD and TD rate is $20.00.
The PPD rate for amputation or permanent total loss of use of a member is the same as the employee’s TD rate.
