Louisiana Houses Passes Bill Broadening Loss of Use Coverage Scenarios

April 26, 2022

The Louisiana House passed a bill Monday that would broaden the requirements of when insurers have to pay loss of use coverage in response to a storm evacuation warning.

House Bill 83 says any loss of use coverage would be satisfied by either a mandatory or voluntary evacuation order issued by a civil authority for the area in which a dwelling is located as a result of a peril covered by the policy. The proposed legislation means that a government-mandated evacuation order wouldn’t be necessary in order for an insurer to have to cover additional living expenses for residents dislocated because of a disaster.

The bill passed by a vote of 68-31 and now heads to the Senate.
