Family of Texas Woman Killed in Propane Truck Collision Files $150 Million Lawsuit

The family of a Texas woman killed in a January collision with a propane truck has filed a $150 million lawsuit against the propane company and the driver of the vehicle, citing negligence and wrongful death.

Nineteen-year-old Yuliana Castillo and her brother Jonathan were driving on FM 2920 in Spring, Texas on January 8 when their Toyota Corolla collided with a Pinnacle Propane company truck driving on the opposite side of the road.

A lawsuit filed by Yuliana Castillo’s family in Harris County District Court alleges the driver of the truck, Daniel Dunbar, failed to control his speed when traffic was slowing. When Dunbar attempted to stop, because of his speed, he began to skid. Dunbar crossed the median into oncoming traffic, slamming into the Castillos’ car.

The Toyota Corolla spun counterclockwise into an adjacent ditch. Dunbar’s truck did not stop and went on to strike a parked commercial truck and trailer.

Yuliana was killed at the scene. Jonathan suffered whiplash injuries, a fracture to his humerus, among other injuries, the lawsuit alleges.

Florida Castillo, the representative of the estate of Yuliana Castillo, is suing Pinnacle Propane and Dunbar for negligence, negligence per se, gross negligence, survival action, bystander claim, and wrongful death.

The lawsuit alleges that Dunbar had a duty to exercise ordinary care and operate the vehicle in a reasonable and prudent manner. Plaintiffs allege the duty was breached by Dunbar’s failure to observe and follow traffic laws and to safely yield and adjust to forward traffic.
