Two Ga. Agents Kept Premiums, Charged With Fraud

Arrest warrants have been issued for two Gainesville, Ga. insurance agents; both are charged with insurance fraud.

Robert Frank Kubitz, 51, allegedly kept premiums paid to his business, RF Kubitz Agency, for coverages including auto liability, workers comp, professional liability and general liability. Kubitz’ clients reportedly had no coverage because he kept their premiums, totaling approximately $36,000, instead of turning the money over to the contracted insurance companies.

Alan Franklin Carter, 53, also allegedly kept premiums paid to him by customers who thought they were purchasing auto and homeowners coverage. So far, Oxendine said, 20 witnesses have come forward; their combined losses total approximately $20,000. Carter was also allegedly selling insurance through Carter Insurance Agency without a valid agent’s license.

“We want to hear from anyone who’s had business dealings with either of these individuals,” Oxendine said. “You can call our Consumer Services Division at 404-656-2070, or toll- free at 800-656-2298, to find out if your coverage is valid.”

Insurance fraud is a felony with a penalty of two to ten years imprisonment, a fine of up to $10,000, or both.

“We’re going to continue to aggressively pursue any form of insurance fraud,” Oxendine said. “Besides being a crime, fraudulent insurance claims cause premiums to go up for the rest of us.”
