Nevada Capitol Police Chief Sues Over Firing

Former Nevada Capitol Police Chief Tom Navin is suing the Nevada Department of Public Safety, claiming he was wrongfully terminated for failing a physical.

Navin, in his district court suit filed this week, contends he was legally exempt from the push-up portion of the test because he was recovering from shoulder surgery.

Navin, who’s seeking $15,000 plus damages, originally injured the shoulder during the push-up test last year. He completed jumping, running and sit-up tests.

He was fired March 15 after state officials said he was unable to complete his physical to maintain his peace officer certification. Officers must pass the physical within a year of being hired.

In his year on the job, Navin oversaw security at the capitol and legislative buildings, the governor’s mansion and other state buildings.
