    I head up our law firm’s tort litigation section for a defense insurance firm. I am double board certified and have been dealing with insurance carriers (mostly for them) for 20 years. I have forwarded the article to every member of my section because it is so well written and, in my opinion, accurate as to conditions I have seen after reviewing a great many claims files which went into litigation. I am very impressed with this author.

    Instructive and well written article. Unfortunately, many insurance companies operate their own claim departments as described. Claim management is geberally measured on an adjustment expense(s) basis … an easy measurement for senior management to utilize .. vs. auditing individuals claim files to get a true picture of how well the staff is doing.
    Subrogation staff should review each active claim file and only sign-off on those files where there appears to be no chance for subrogation. It is very likely that inside adjusters are also overlooking contribution opportunities due to excessively high work load.
