TPA Activities. Some agencies are unknowingly conducting TPA activities. Others are knowingly offering these services without knowing whether their E&O policy will provide coverage. Many insurance agency E&O policies specifically exclude coverage for TPA activities/services.
TPA services can create significant exposures which is why most agencies avoid them entirely. If your agency is going to provide such services, it might be wise to determine whether the agency’s insurance policies provide any coverage for them. If not, make sure your producers get the message that such services must cease.
