Allstate Back in Business, Fla. Court of Appeals Grants Stay

Allstate and Allstate Floridian are pleased with the Florida First District Court of Appeal’s decision to grant an immediate stay from the Florida Office of Insurance Regulation’s order to cease writing new business.

In a written statement, Allstate said, “The ruling allows Allstate’s more than 1,100 Florida agents and their employees to continue to create jobs and serve their communities while we continue to provide the OIR with information.”

Allstate Floridian Insurance Company and Allstate Floridian Indemnity Company are independent subsidiaries of The Allstate Corporation and are the primary providers of personal lines property insurance in Florida for the Allstate group.

Property insurance policies sold by Allstate Floridian Insurance Company and Allstate Floridian Indemnity Company are not underwritten or reinsured by any other company in the Allstate group.

Florida Gov. Charlie Crist’s reaction to the court’s decision is consistent with his stance on insurer-consumer relations in his state.

“For too long, insurance companies have ignored the needs of their customers and unfairly taken advantage of Florida homeowners,” Crist said. “I am disappointed by the recent action by the First District Court of Appeal to stay Allstate’s suspension. I urge Commissioner McCarty to act as early as Tuesday to show why the order suspending Allstate’s license should remain in effect.

Earlier on Friday, Florida Insurance Commissioner Kevin McCarty issued a statement saying, “My office has received Allstate’s emergency motion for immediate relief and is currently reviewing it very carefully.

“I stand behind the order I issued Thursday suspending the Allstate companies from writing any new business in Florida until they have fully complied with the subpoenas my office sent them Oct. 16.

“This is just another step in the process that enables Allstate to further delay production of the documents we requested.

“Allstate’s motion is not unexpected, and it will not stymie my commitment to Florida’s consumers to get to the bottom of this issue.

“We are considering our legal options, and I will do everything within my authority as Florida’s insurance commissioner to ensure that the suspension remains in effect and that Allstate produces the documents requested by my office.

“We don’t know what action the First District Court of Appeals might take, but you can expect my office to take each and every action necessary to protect Florida consumers.”
