School districts in North Carolina may soon be barred for five years from suing their counties over the amount of funding they receive under a new provision approved by the state Senate.
The Senate passed on July 22 a bill that included an amendment filed by Sen. Dan Soucek, R-Watauga, imposing the five-year moratorium. The amended bill will now go to the House for concurrence.
Soucek said lawsuits between subdivisions of the same county have cost North Carolina taxpayers millions of dollars as school districts chose to fight their funding levels. He said the moratorium was meant to cool relations between school districts and their counties over funding issues.
Sen. Joyce Waddell, D-Mecklenberg, tried unsuccessfully to place a separate amendment on the bill that would undo Soucek’s changes.
