A judge in Louisville has ruled that a local traffic school program run by the Jefferson County Attorney’s office is unconstitutional.
Judge Sean Delahanty ruled the state law allowing such programs “is a poorly written statute that was rushed into implementation and is constitutionally flawed.” The Courier-Journal reports the program has generated $1.2 million in revenue for the county attorney’s office.
County Attorney Mike O’Connell said Oct. 23 the Drive Safe Louisville program is valid and his office will continue it.
Under the program, drivers can pay $179 to take an online class to get a moving violation citation dismissed. O’Connell’s office gets $75 from each fee.
Delahanty says by allowing the county attorney to dismiss traffic cases, the program interferes with the powers of the judiciary.
